DUI Penalties in the San Tan Justice Court

A DUI conviction in the San Tan Justice Court will lead to a substantial penalty. How harsh that penalty is depends largely on the Blood Alcohol Concentration, or BAC, that was present in your case. All DUI’s charged in the San Tan Justice Court do have some punishments in common, however:

  • All are Class 1 Misdemeanors. It’s important to know that some DUIs can be felonies, and so you should speak to your attorney about whether your DUI case can be charged as a felony
  • Maximum 6 months jail sentence
  • Maximum $2,500 fine
  • Probation up to 5 years
  • Loss of driving privileges
  • Ignition interlock device will be required
  • 8 points assessed against driving record

DUI’s can be broken down into categories based on the BAC as “Regular,” “Extreme,” or “Super Extreme.”

Regular DUI

Regular DUI’s will BACs of 0.08 or more but less than 0.15. They may also allege impairment to the slightest degree, regardless of BAC. The mandatory minimum punishment is 10-180 days in jail, $250 fine plus surcharges, approximately $1,000 in assessments, and alcohol screening and treatment classes.

If you have been convicted of a DUI in the last 84 months the punishment is increased to 90-180 days in jail, a $500 fine plus surcharges, approximately $2,500 in assessments, alcohol screening and treatment classes, and a minimum of 30 hours of community service.

Extreme DUI

Extreme DUI’s will have a BAC of 0.15 or more but less than 0.20. The mandatory minimum punishment is 30-180 days in jail, a $250 fine plus surcharges, approximately $2,000 in assessments, $250 to the DUI abatement fund, and alcohol screening and treatment classes.

If you have been convicted of a DUI in the last 84 months the punishment is increased to 120-180 days in jail, $500 fine plus surcharges, approximately $2,500 in assessments, $250 to the DUI abatement fund, alcohol assessment and treatment classes, and a minimum of 30 hours of community service.

Super Extreme DUI

Super Extreme DUI’s have a BAC of 0.20 or higher. The mandatory minimum penalty is 45-180 days in jail, a $500 fine plus surcharges, $250 to the DUI abatement fund, approximately $2,000 in assessments and fees, and alcohol screening and treatment classes.

If you have been convicted of a DUI in the last 84 months the punishment is increased to 180 days in jail, a $1,000 fine plus surcharges, $250 to the DUI abatement fund, approximately $2,500 in assessments and fees, alcohol screening and treatment classes, and a minimum of 30 hours of community service.
