Felony DUI – Sedona
If you are charged with a DUI in the Sedona Municipal Court then it is a misdemeanor. However, DUIs in Arizona can be charged as felonies, and when they are they will be called Aggravated DUIs. The punishments for Aggravated DUIs are incredibly harsh, even when compared to the harsh penalties meted our for misdemeanor DUIs. An arrest for a DUI in Sedona may lead to an Aggravated DUI based on its facts. Aggravated DUIs can be charged if:
- You drove the wrong way
- Your license was suspended
- There was a minor under the age of 15 in the car
- You were required to use an ignition interlock device
- Your have two or more prior DUI convictions with an 84 month period
Aggravated DUI Penalties
The minimum sentence for an Aggravated DUI is 4 months in prison along with probation. That sentence may be increased to 3.75 years in prison. These sentences may be even higher if you have been previously convicted of a felony.
Where Will Felony Charges Be Filed
Because Sedona straddles two counties, Aggravated DUI charges in Sedona may be filed in the Coconino County Superior Court or the Yavapai County Superior Court, depending on where in town your arrest took place.
