Congrats to the Class of 2018!!! . . . Now Don’t Get Arrested by Police During the Graduation Pomp and Circumstance

Late May and early June means high school graduation, and from all of us here at the Rosenstein Law Group we wish our Arizona grads the most heartfelt congratulations! Proms, graduation ceremonies, and grad parties are an exciting time for both the graduates themselves and their proud families and friends. Butduring all the pomp and circumstance make sure to be safe and aware of the potential legal pitfalls. Police are on the lookout this month to make arrests for alcohol-related offenses and other crimes that often occur whenever our citizens are out celebrating.

For the graduating seniors, remember while your high school days are over, you are still not twenty-one and can still be cited for a number of offenses including:

(1) Minor in Possession;

(2) Minor in Consumption;

(3) Fake ID;

(4) Disorderly Conduct or Public Nuisance (drunk in public);

(5) Underage Driving while under the Influence of Alcohol (“Baby DUI”); and

(6) DUI.

For those under 21, remember you have a right to remain silent, so if a police officer questions you about any of these crimes do NOT answer any questions, refuse to complete any type of tests, and firmly but politely REQUEST TO CALL YOUR ATTONEY AT (480) 248-7666.

For parents and adult friends of graduates, here are a list of typical arrests of adults during this season:

(1) Furnishing Alcohol to Minors;

(2) Disorderly Conduct or Public Nuisance (drunk in public);

(3) DUI.

The same advice for crimes one and two applies for you and your kids. Do NOT answer any questions, and Firmly but politely REQUEST TO CALL YOUR ATTONEY AT (480) 248-7666.

Here are list of Do’s and Don’ts” for both the graduates and their family and friends if they are stopped by an officer who starts doing a DUI or “Baby-DUI” investigation:

DO: Provide your name, license, registration, and insurance.

DO: Firmly but politely REQUEST TO CALL YOUR ATTONEY AT (480) 248-7666.

DO: Firmly but politely request to be immediately released to obtain an independent

chemical test.

DON’T: Answer the officer’s questions – Your words will be used against you.

DON’T: Agree to do the eye test – it is unwise.

DON’T: Agree to do any balancing tests – it is unwise.

DON’T: Agree to do a blood, breath, or urine test until you have TALKED WITH AN

ATTORNEY – or until the officer advises you that “you’re entitled to No Further

Delay.”
