Where were you arrested? A DUI is a state offense, but each jurisdiction handles them slightly differently.

Try to stay calm during sobriety tests

If you have ever been investigated on suspicion of drunk driving, you will already know how stressful the experience can be. It is something that happens to drivers every day in Arizona, in order to keep the roads as safe as possible. However, although many of the tests used to determine whether an individual is intoxicated are very accurate, they can still give misleading results from time to time.

This is a big problem if you are the subject of a test that gives a misleading result. You could be mistakenly charged with drunk driving and, if convicted, could face fines, the loss of your license or even a prison sentence. As such, it is important to know what to expect from a DUI investigation and be prepared to challenge any evidence that falsely incriminates you.

One element of such investigations that can be problematic is the execution of field sobriety tests. These work by testing your coordination and reactions, but they can be misled if there are other factors interfering with your ability to complete the tests. For example, if you are shaken up by an accident, you may struggle to focus or even walk in a straight line.

Similarly, if you have a medical condition that affects your movement this could also cause you to fail the tests. It can be extremely upsetting and frustrating knowing that you are being falsely accused, but it is often helpful to remain as calm as possible. If you react aggressively to the officers involved, it could get you into further trouble.

Our page on field sobriety tests has further information on what you can do if charged with drunk driving. You may also benefit from the advice of an attorney. He or she can assess your situation and may be able to help you ensure that your side of the story is heard by the court.
