Where were you arrested? A DUI is a state offense, but each jurisdiction handles them slightly differently.

Commercial drivers face stricter DUI restrictions

If you drive a vehicle that requires a commercial driver's license, such as a tractor-trailer or a bus, you are subject to far stricter rules when it comes to intoxication. As commercial licenses tend to be needed for very large vehicles or those that can carry several passengers, the driver's of these vehicles have an increased responsibility. If they have an accident, there is even greater potential for damage and loss of life than there may be if a smaller vehicle crashes.

As is explained on the DMV website, in Arizona, the responsibility of these drivers is taken very seriously. As such, the DUI limits imposed on them are even lower than they are for other drivers. While a blood alcohol concentration of 0.08 percent or above is enough to earn another driver a DUI charge, for commercial drivers that limit is halved to 0.04 percent.

Furthermore, if a commercial driver is found to have any alcohol at all in his or her blood or breath, they can be removed from service for a full 24 hours. On top of Arizona's state laws, commercial drivers are also subject to federal regulations regarding DUI and other offenses. A charge of this nature, whether on a state or federal level could lead to the suspension of your license or even its disqualification.

Facing charges of this nature could have serious consequences, particularly if you are convicted. This is especially the case if you lose your license as it could prevent you from working and providing for your family. A good defense is critical and an attorney might be able to provide the advice you need. By acting quickly and with the correct guidance you may be able to avoid conviction and protect your future.
