Aggressive Driving

Aggressive driving in Chandler is a criminal traffic violation. There are essentially two main requirements of aggressive driving that a person could be charged under, and each requirement has a variety of possible volitions. Specifically, if an individual either exceeds a reasonable and prudent speed on the highway or exceeds a prescribed speed limit in designated areas (including business/ residential areas or school zones) and drives in a manner that causes an immediate hazard to another person or their property and violates two of the listed traffic violations in the same conduct—that person could be charged with aggressive driving. The listed traffic violations are provided for you below. Remember, two of these violations must occur in addition to the above-stated conduct:

• Failing to obey traffic signs and signals
• Overtaking or passing another vehicle on the right by driving off of the pavement or primary traveled portion of the road
• Unsafe lane changes
• Following another vehicle too closely, or
• Failing to yield to the right of way

A person who is guilty of aggressive driving is guilty of a class 1 misdemeanor and is in danger of having their license suspended for an entire year.
