Where were you arrested? A DUI is a state offense, but each jurisdiction handles them slightly differently.

Roadside tests are not always accurate

Many drivers in Arizona have been stopped at some point or another. Often officers simply need to run some routine checks and then they can send you on your way. However, if you fail certain tests, such as field sobriety tests, it is possible that you will be accused of driving under the influence of drugs or alcohol. Not only could this cost you your license, but it could also lead to criminal charges.

There are many reasons you could fail a field sobriety test. Perhaps you have a medical condition that affects your movement or your eye movements. Perhaps you are fatigued and struggling to concentrate on the tests. It may even be that you are simply nervous about the tests and unable to perform as well as you should.

Whatever the case, it could put you in a difficult position. Officers will want to know why you struggled with the tests and may assume that you are under the influence of alcohol or drugs. Fortunately there are other tests they can do to verify this, so you may still escape without being charged. However, if you are shown by another test, such as a breath test or blood draw, to be over the legal limit, you are likely to face drunk driving charges.

Our page on field sobriety tests explains in more detail the various things that could go wrong. Even so, it is important to remain calm and collected so you can carefully observe the circumstances of your arrest. If any mistakes are made in the process, you may be able to use that in your defense to help you escape conviction. An attorney can advise you about your options and might be able to assist you in choosing the best course of action to take.
