Arizona man accused of being 3 times over the limit

Posted on June 5, 2014 in Felony DUI

In Arizona, the legal limit for blood alcohol content when driving is 0.08 percent. As most drivers know, being found to be over this limit when behind the wheel can result in serious charges. In their drunk driving enforcement, police will often use tests to try to determine a person’s blood alcohol level.

Police say that, when they pulled over a 27-year-old man in Mohave County, a smell of alcohol was present in his vehicle. They had stopped him initially for allegedly exceeding the speed limit, traveling at 52 mph in a zone where the limit is at 35 mph. He was asked to perform field sobriety tests, but the results of those have not been reported. Later, atthe Sheriff’s Office, his blood alcohol level is said to have tested at 0.262 percent, more than three times Arizona’s limit.

The driver allegedly denied drinking. Nevertheless, he was arrested under suspicion of felony aggravated DUI and may now be facing criminal proceedings.

In any drunk driving case in which there are BAC test results, it is very important to look at the specifics of how the tests were conducted. It is possible for mistakes or misconduct during the testing process to lead to inaccurate results that could leave a person falsely incriminated or facing more serious charges than they should be.

When it comes to issues regarding BAC tests or any other issues in a DUI case, a defense attorney can be of great help. Such attorneys can look into things such as whether anything occurred during a BAC test that would be grounds to challenge whether the results of the test should be considered in the case.
