Following a DUI arrest in Tempe, you will be provided with your arraignment date (which is your first court date) at Tempe Municipal Court. This will begin the proceedings in criminal court. The initial stop, sobriety and chemical testing, and arrest will be put under great scrutiny by your attorney from the Rosenstein Law Group. The administrative part of your DUI case involves Arizona’s Motor Vehicle Division (MVD). A process separate and apart from the criminal court case plays out in the MVD.
The MVD will pursue suspension of your driver’s license after your DUI arrest. We move fast to request an MVD hearing (which must be done within a specific time frame) and minimize the consequences, including lower suspension times and/or the opportunity for a restricted license to go to work, school or medical appointments. The MVD hearing will also provide us with a good way to gather more evidence and will assist us as we move forward on the criminal component of your case.
