IN ARIZONA FOR A FIRST OFFENSE DRIVING UNDER THE INFLUENCE CONVICTION, DO I NEED A Certified Ignition Interlock Device FOR THE MOTOR VEHICLE DIVISION, THE COURT, OR BOTH?

THE QUICK ANSWERS:

MOTOR VEHICLE DIVISION

COURT

For A DUI Conviction, a Certified Ignition Interlock Device May Be Required As Part Of the Agreement for the Court if you are sentenced pursuant to A.R.S. ยง 28-1382(I):

Notwithstanding subsection D, paragraph 1 of this section, at the time of sentencing if the person is convicted of a violation of subsection A, paragraph 1 of this section, the judge may suspend all but nine days of the sentence if the person equips any motor vehicle the person operates with a certified ignition interlock device for a period of twelve months. If the person is convicted of a violation of subsection A, paragraph 2 of this section, the judge may suspend all but fourteen days of the sentence if the person equips any motor vehicle the person operates with a certified ignition interlock device for a period of twelve months. If the person fails to comply with article 5 of this chapter and has not been placed on probation, the court shall issue an order to show cause as to why the remaining jail sentence should not be served.

OKAY, SO IF I END UP WITH AN INTERLOCK HOW LONG WILL IT BE?

The length of an Interlock requirement for a first offense Driving Under the Influence Conviction in Arizona generally ranges from the super mitigated term of Six (6) Months, to Eighteen (18) Months.

A certified ignition interlock device will need to be calibrated once a month as well. It is important to keep calibrations checks up to date and keep your records. Many Certified Ignition Interlock Device companies report the calibration checks to the Motor Vehicle Division - but not to your Court.

You want to make sure that you speak with an experienced Arizona Driving Under the Influence attorney to explain what your interlock term will be why you have a Certified Ignition Interlock Device requirement, and why it needs to be calibrated.
