Where were you arrested? A DUI is a state offense, but each jurisdiction handles them slightly differently.

Know your limits to avoid DUI charges

Many drivers in Arizona enjoy a drink from time to time. However, it is always important to bear in mind the legal limits for blood alcohol concentration when driving. The limit is generally 0.08 percent, although it can be even lower for commercial drivers or drivers under the legal drinking age. If you are found driving with a BAC which is equal to or in excess of the limit, you could be charged with drunk driving.

Of course, you may be someone with a high alcohol tolerance. Some people take far longer to experience significant impairment from intoxication. However, it is vital to remember that DUI laws BAC tests are not concerned with how functional you are after drinking a certain amount of alcohol. They are designed to measure the concentration of alcohol in your blood, so if this is too high, you may be charged even if you felt fully in control of your faculties.

One of the most common ways for your BAC to be tested is via a Breathalyzer. These devices are generally thought to be very accurate. However, they can give false readings, particularly if they have been poorly maintained. If you suspect that you have been incorrectly charged with drunk driving, you may be able to challenge the results of the test.

Our page on blood alcohol tests has further information on how you may be able to refute a false reading and the support that might be available to you. An attorney may also be able to assist you with your defense and suggest the best course of action to take in order to clear your name and avoid conviction.
