Was your drunk driving arrest legal?

Many motorists in Arizona will have been pulled over at some point. It may have been because a headlight was out, because their driving looked erratic or even because there had been a report made about their vehicle. However, if you are stopped by officers in this way, there is a chance that you might be investigated for drunk driving. If found to be intoxicated, you could then face criminal charges.

If it turns out that you were over the legal blood alcohol limit, meaning your BAC was found to be 0.08 percent or above, this could have serious consequences. However, even if you are in a position where conviction seems extremely likely, there are still lines of defense that you can consider. For example, if the circumstances of your arrest did not conform to legal requirements, the charges against you may be invalid.

If the officer who stopped you is found not to have had a good reason to stop you, this could work in your favor. Similarly if any of the tests performed in order to determine your sobriety were carried out incorrectly or the officer responsible was not adequately trained, this could also call the evidence against you into question.
