If you are arrested for a DUI in Arizona, you have the right to contact an attorney. In fact, under Arizona law, a person has the right to consult in private with an attorney as soon as feasible after he or she is taken into custody. It is important that you exercise this right and request to speak with an attorney as soon as possible because the attorney canprovide you with legal advice regarding your specific situation, and explain to you exactly what is going to occur while you are in police custody.

However, if you are denied your right to counsel, or the police somehow interfere with your right to counsel, that fact is something you will want to discuss in detail with your DUI defense attorney. Your DUI attorney will review the facts of you case, and determine if your rights were violated. If it appears thatyour right to speak with an attorney was violated in any way, your lawyer can file a motion with the court and ask the judge for the appropriate remedy for the violation (which in some cases may be dismissal of your DUI case, or may be suppression of the evidence obtained against you by the police).

1. request to speak with an attorney after you are taken into custody, and
