Set Asides in the Kyrene Justice Court

Although many of our neighboring states offer those convicted of crimes an opportunity to completely clean their records, Arizona does not. If you want to clean up your record, the next best thing you have is the ability to apply for a set aside.

If you successfully apply for a set aside in the Kyrene Justice Court, Arizona Revised Statutes § 13-907 provides that the judgment of guilt will be set aside, and that the Court will dismiss the charging instrument and order you released from all penalties and disabilities resulting from the conviction, save for some specific department of transportation and game and fish commission ones.

If granted, you can essentially say your case was dismissed as the set aside acts to dismiss the charging instrument and set aside judgment of guilt.

When considering whether it should grant a set aside, the Kyrene Justice Court is required to look at:

• The nature of the offense
• Your compliance with the sentence
• Prior or subsequent convictions
• Victim input
• Time since completion of sentence
• Your age at the time of conviction
• Any other relevant factor

There are some offenses that may never be set aside.
