Bars on Bikes: Can you get a DUI on a bicycle?

People often ask if someone can be convicted of a DUI on a bicycle. Unfortunately, there is no Arizona law which directly addresses this issue. However, an analysis of Arizona law suggests that a conviction for a DUI on a bicycle would be unlikely.

Signed or Unsigned- Can a ticket be used as evidence?

Many defendants ask whether it matters if the officer signed the complaint or ticket at the site of issue. Unfortunately, this is a complicated topic without a concrete answer. Arizona cases have not addressed this question squarely; however, in Erdman v. Superior Court of Maricopa County, the court held that lack of a signature alone was reason enough to dismiss the case. Erdman v. Superior Court, 102 Ariz. 524, 433 P.2d 972 (1967). In Erdman, one officer arrested the defendant while another officer signed the complaint. The issue was whether a criminal complaint was signed by someone who merely relied on another's information, which said that the defendant committed some illegal activity, and if that is sufficient to present in court.

Not only are people horrified to learn that the police officers here can haul you into the jai and forcibly draw your blood themselves, but are more shocked by the draconian the sentencing scheme which provides for some of the harshest penalties in the nation.

Do Police Officers Lie?

In my line of work, I deal with police officers from all over the Valley on a daily basis. To some people, this may seem interesting, and I am often asked the question whether police officers lie. Unfortunately, the answer is yes. After years of practicing criminal law, I have become jaded by how prevalent dishonesty is within the law enforcement community. As a child of the 1980's, I was raised to believe that cops were honest people, always to be trusted in times of need, and if I ever needed help I should always seek one out. It is a sad concept to me that I won't be giving the same advice to my daughter as she grows up. In three separate court hearings this week alone, the Rosenstein Law Group has been able to prove that certain police officers were not telling the truth under oath. The conundrum of this situation is that while this deceit bodes badly for society as a whole, this dishonesty was actually favorable here for our clients; we forcefully argued that catching officers in a lie under oath discredits the entire investigation. The sad reality is that far more often we are unable to prove the officers were lying, because there is no objective evidence contradicting these falsehoods, just our client's word.

SB 1200 Is Now in Effect: Arizona DUI Laws Have Changed

Only accountants and lawyers can tinker with things so much and get away with making a process so complicated that you need to hire their services. A shining example of that is Arizona's SB1200. This is the biggest re-write of the Arizona DUI laws since the 1990s, and despite the overly simplistic analysis done by the local Arizona news programs on SB 1200, the law doesn't just affect the required ignition interlock time.
