Where were you arrested? A DUI is a state offense, but each jurisdiction handles them slightly differently.

Be prepared for a field sobriety test

If you are stopped while driving in Arizona, there is a chance that the officer who has pulled you over suspects you of drunk driving. If so, he or she may ask you to submit to a number of tests to determine your blood alcohol concentration and whether your ability to drive is impaired in any way. If you are found to be under the influence of alcohol, you could be charged.

Of course, there are many reasons you might fail a field sobriety test. You could have mobility problems or be affected by the stress of being pulled over. You may even be injured or affected by some other medical condition. This can be a worrying prospect, and you might feel inclined to refuse the test. However, this could result in your license being suspended.

Fortunately, the law considers you to be innocent of the charges against you unless you can be found guilty beyond any reasonable doubt. As a result, even if you fail the field sobriety test, you may be able to challenge the results.

If you are facing DUI charges or you are concerned about the results of a field sobriety test, our page on drunk driving may have some of the answers you need. An attorney could also prove helpful as you navigate the legal process and work to build your defense. He or she can explain the charges against you and may be able to help you ensure that your side of the story is heard by the court. With this guidance, you can work toward avoiding conviction or at least minimizing the sentence you face.
