Cave Creek man charged with DUI refused alcohol testing

A Cave Creek man was reportedly arrested earlier this month on charges that he drove while intoxicated. According to court documents, the man told arresting officers that he had not been drinking and he refused to submit to a breath test. He was eventually arrested on suspicion of driving under the influence after officers saw two open beer cans in his vehicle.

Should this man have been arrested for drunk-driving?

When an individual is arrested for driving under the influence, it is expected that police have probable cause to make that arrest. Probable cause means sufficient evidence to believe that the individual being arrested has committed the crime. Police are not infallible in this task, though, and their judgments can be flawed. A man arrested last June for drunk driving in Austin may have had such an experience.

The big number this year for DUI arrests in Arizona during St. Patrick's Day festivities -- a four-day period, according to law enforcement -- is 413. That number is up by 49, compared to last year. One thing that remains to be seen is the number of accused individuals who are actually convicted.

Field Sobriety Tests - A Lose/Lose Proposition

Ever try to walk a straight line or stand on one leg after a few drinks? It is always entertaining at a party amongst friends, but could be very harmful to your case if a police officer ever asks you to perform them in a DUI investigation. The common misconception with field sobriety tests (FST's) is that if one does well on the tests, then they will be free to drive home, free of consequence. That is seldom the case, as the officer typically already has signs and symptoms of impairment if he is asking you to get out of your car and perform the tests.

Kerry Kennedy Acquitted on Drug DUI Charges

On Friday, Feburary 28th, 2014, Kerry Kennedy, daughter of the late Sen. Robert F. Kennedy, and former wife to New York Gov. Andrew Cuomo, was acquitted on DUI Drug charges. The 54-year old was charged with driving while impaired after she swerved and hit a tractor-trailer in her Lexus SUV in morning rush-hour traffic.

"Close Only Counts in Horseshoes and Hand Grenades"

As many know, a breathalyzer is a machine that police officers and prosecutors often use to measure a person's blood alcohol level (BAC), when they feel a person is driving under the influence. How a breathalyzer works is, it takes a small sample of a person's breath and estimates how much alcohol is in the sample. Then the officers and prosecutors use these results to estimate how much alcohol is in a person's blood. In the state of Arizona, the legal limit of a person 21 years and older is a BAC of 0.08%. If a person is asked to perform a breath analysis test and the machine records the person's BAC as over the legal limit, then they will be arrested and prosecuted for DUI, and the breathalyzer results could become central to the prosecution's case.

The Great Arizona Beer Festival at Tempe Beach Park: 03/01/2014

This past weekend the Rosenstein Law Group was happy to have a presence at The Great Arizona Beer Festival at Tempe Beach Park reminding participants to not drink and drive. This festival showcased over 50 of our country's finest breweries and over 200 original craft beers. Even though the weekend was abnormally rainy for Arizona, it did not stop beer-lovers from putting on their ponchos and having a good time. We were happy to also remind them to have a safe one.

We play an active role in the civic life of the Phoenix metropolitan area.
We support Scottsdale's Taste of the Town festival that benefits the local chapter of the Muscular Dystrophy Association as well as the annual Toys for Tots campaign. Our firm also contributes to a number of other local organizations, including Home 'Fur' Good, a nonprofit dedicated to eliminating the euthanasia of adoptable homeless cats and dogs in Maricopa County.
