Underage DUI

Arizona is a Zero Tolerance State

Effective Defense for Underage DUI

If you are under 21, you do not want a DUI conviction on your record. Aside from possible jail time and loss of license, the misdemeanor record sticks with you forever, with implications for college entrance, job opportunities and high insurance rates. Our Scottsdale law firm has helped many Arizona State University students, military personnel and other minors avoid the worst consequences of drinking and driving.

Underage DUI? Call Our Defense Lawyer Day or Night
Before you agree to plead guilty to a minor DUI or a straight DUI, you should get competent legal advice. There may be opportunities to plead to a lesser offense or to avoid a criminal record all together. Contact the Rosenstein Law Group immediately at 623.239.4468.

"Minor DUI" Must Be Taken Seriously

Under Arizona statute ARS 4-244(33), it is illegal for a person under age 21 to drive or be in physical control of a car with any alcohol in their system. You can be charged with this offense if police do not have enough evidence to convict you of a regular DUI. One beer is enough to trigger a conviction, resulting in a two-year license suspension and misdemeanor record.

Straight DUI Charges for Underage Drivers

If you are under 21 but register a blood-alcohol content (BAC) of .08 or greater, you will face all the penalties that a person over 21 would face. The court will not show mercy because of your tender age. In fact, many judges are actually harsher on minors charged with DUI. Penalties for a conviction on first offense may include a jail term, 2-year license suspension, fines, ignition interlock on your vehicle, alcohol assessment and counseling with numerous classes and impact panels, probation and community service.

Underage DUI Defense

Knowing the long-term impact of a drunk driving conviction for a young person, attorney Craig Rosenstein applies aggressive strategies to counter the charges. He examines the officer's reason for the traffic stop and evidence for arrest, examining every piece of the prosecution's evidence. If he cannot get charges dismissed or evidence suppressed, Mr. Rosenstein is knowledgeable about many alternatives and lesser pleas available to underage defendants when the case is properly handled.
